BEGINNING, AND BRINGS US THESE BOB: ANGEL RIVERA IS ACCUSED OF MURDER, ALONG WITH HIS SON CHRISTOPHER OTERO-RIVERA. BUT TOMORROW HE COULD WALK OUT OF JAIL, BECAUSE PROSECUTORS STILL HAVE NOT FORMALLY CHARGED HIM WITH KILLING HIS SON’S ESTRANGED WIFE, NICOLE MONTALVO. IT’S VERY UNUSUAL FOR THE STATE NOT TO FILE, ESPECIALLY A HOMICIDE CHARGE, WITHIN THEIR REQUISITE PERIOD OF TIME BOB: FRANK BANKOWITZ IS RIVERA’S LAWYER, AND FILED THIS MOTION TO GET HIM RELEASED FROM JAIL BECAUSE MORE THAN 33 DAYS HAVE PASSED WITH NO CHARG AN OSCEOLA COUNTY JUDGE WILL HEAR THAT ARGUMENT TOMORROW, AND IT’S THE SAME RULE THAT HIS SON’S TEAM MADE SUCCESSFULLY YESTERDAY, WITH NO PUSHBACK FROM PROSECUTORS. >> THE COURT HAS NO OPTION UNDER THE LAW BUT TO RELEASE HIM ON HIS OWN RECOGNIZANCE AS TO THIS CASE BOB: OTERO-RIVERA CAN’T GET OUT YET BECAUSE HE HAS A SEPARATE CASE WITH NO BOND, BUT HIS FATHER, ANGEL, DOESN’T HAVE THAT HOLDING HIM BACK. BOB ARREST RECORDS FOR THE MEN : ARE ALMOST COMPLETELY REDACTED. BUT WESH 2 HAS BEEN ABLE TO DETERMINE SOME OF THE EVIDENCE. AT THE HOME, WE COULD SEE HUGE PILES OF DIRT DUG UP OUTSIDE. WELL RECORDS SHOW PROSECUTORS HAVE GPS DATA FROM AN EXCAVATOR, A 90 — A 911 CALL, 75 ROUNDS OF AMMUNITION, THREE SHOTGUN SHELLS IN A SCREENED IN PATIO. Man accused in daughter-in-laws slaying facing new charges

An Osceola County man accused of murdering his former daughter-in-law was seeking to be released from jail after the state attorney’s office failed to file charges. Now, Angel Rivera is facing new charges that were filed on Wednesday.Attorneys for Rivera asked that he be released from jail because the state attorney’s office had not filed formal murder charges against him in the death of his daughter-in-law, Nicole Montalvo. Rivera is now facing charges for abuse of a dead human body and failure to report the deaths. He will be held without bond on those charges until he sees a judge on Thursday. Attorneys for Montalvo’s husband, Christopher Otero-Rivera, successfully argued Tuesday that because the state attorney’s office has not formally filed charges, he should be released. Otero-Rivera was granted his release for the murder case, but remains jailed on a violation of probation charge. The state attorney’s office said Tuesday that there is not enough evidence to proceed with the case at this time.Ann Marie Collins, a friend of Montalvo’s, said Tuesday that she feels like the state has let her friend down.”To hear that he (Otero-Rivera) could have been released if didn’t have the violation of probation is heartbreaking. If he gets out, he’s going to hurt somebody else,” Collins said.

An Osceola County man accused of murdering his former daughter-in-law was seeking to be released from jail after the state attorney’s office failed to file charges.

Now, Angel Rivera is facing new charges that were filed on Wednesday.

Attorneys for Rivera asked that he be released from jail because the state attorney’s office had not filed formal murder charges against him in the death of his daughter-in-law, Nicole Montalvo.

Rivera is now facing charges for abuse of a dead human body and failure to report the deaths. He will be held without bond on those charges until he sees a judge on Thursday.

Attorneys for Montalvo’s husband, Christopher Otero-Rivera, successfully argued Tuesday that because the state attorney’s office has not formally filed charges, he should be released. Otero-Rivera was granted his release for the murder case, but remains jailed on a violation of probation charge.
