WESH 2 NEWS INVESTIGATIVE REPORTER GREG FOX IS LIVE ALONG THE INTERSTATE. GREG, WHAT DID OSHA FIND? GREG: IT FOUND THAT IN THIS AREA NEAR WYMORE ROAD AND FAIRBANKS THAT SGL DID NOT HAVE THE PROPER SAFETY PROCEDURES IN PLACE TO PREVENT THE WORKER’S DEATH. JAMES MLLS WAS JUST DOING HIS JOB FEBRUARY 4, WHEN IT COST HIM HIS LIFE. HE WAS WORKING ALONG THE I-4 ULTIMATE CONSTRUCTION PROJECT WHEN HE WAS FATALLY STRUCK BY A STEEL PIPE. NOW, ACCORDING TO DOCUMENTS OBTAINED BY WESH 2 INVESTIGATES, CONTRACTOR SGL HAS BEEN CITED AND FINED BY THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION. OSHA SAID SGL FAILED TO PROVIDE A WORKPLACE FREE OF RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES, IN THAT EMPLOYEES WERE EXPOSED TO A STRUCK-BY HAZARD. OSHA HAS FINED SGL IN THE WORKER’S DEATH, FOR A SERIOUS SAFETY VIOLATION $13,260, AND FOR AN OTHER-THAN-SERIOU VIOLATION, MORE THAN $1800 FOR A TOTAL FINE OF $15,150, WHICH WAS DUE TO BE PAID OR CONTESTED BY THIS WEEKEND. MILLS’ DEATH WAS THE 4TH SINCE I-4 ULTIMATE CONSTRUCTION BEGAN. THE FIRST WAS IN 2016, WHEN TRUCK BACKED OVER MARVIN FRANKLIN, LEAVING HIS FAMILY, INCLUDING THREE CHILDREN, DEVASTATED. >> MY SON, LYING ON THAT PAVEMENT JUST CRUSHED TO DEATH AND I COULDN’T EVEN SEE HIM THAT ONE LAST TIME. GREG: OSHA FINED SGL MORE THAN $12,000 FOR A SERIOUS VIOLATION. WHILE A SETTLEMENT TO THE FRANKLIN FAMILY’S LAWSUIT IS PENDING, WESH 2 INVESTIGATES UNCOVERED DOCUMENTS THAT SHOWED SGL MADE CHANGES TO THE WAY IT ROUTES TRAFFIC IN CONSTRUCTION ZONES TO PREVENT FUTURE MISHAPS. LATER IN 2016, CURTIS POPKEY WAS KILLED WHEN HE WAS STRUCK BY A PIECE OF CONSTRUCTION EQUIPMENT IN ALTAMONTE SPRINGS. OSHA LEVIED NO FINES IN THAT CASE. AND IN MARCH OF LAST YEAR, MICHAEL TOLMAN DIED AFTER BEING STRUCK BY A COLLECTION OF RIBAR. SGL SUBCONTRACTOR SHELBY ERECTORS WAS FINED MORE THAN $12,000. SAFETY ADVOCATES SAY OSHA FINES NEED TO BE HIGHER TO PROMOTE SAFETY. IN A 2015 NEW YORK-BASED REPORT, A STUDY OF CONSTRUCTION DEATHS CONCLUDED CONSTRUCTION WORKER FATALITIES RESULT IN PUNY PENALTIES FOR UNSAFE CONTRACTORS. NATIONALLY, OSHA INSPECTS FEWER THAN 4% OF CONSTRUCTION SITES. IN 2016 AFTER THE REPORT WAS RELEASED, CONGRESS INCREASED OSHA FINES 78%. IT WAS THE FIRST INCREASE IN 26 YEAR MY EMAILS TO SGL WERE NOT RETURNED.

The Occupational Safety and Health Administration has issued a citation to the builder of the I-4 Ultimate construction project following a worker’s death, according to documents.James Mills was working along the I-4 Ultimate construction project Feb. 4 near Wymore Road and Riddle Drive when he was fatally struck by a steel pipe.According to the documents obtained by WESH 2 Investigates, SGL has been cited and fined by OSHA.OSHA said SGL failed to provide a workplace free of recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a struck-by hazard.OSHA fined SGL $13,260 in the worker’s death for a serious safety violation. The agency also fined SGL for an additional $1,895 for an other-than-serious violation, in total a fine of $15,150.The payment for the fine was due to be paid or contested by this weekend.Mills’ death was the fourth since I-4 Ultimate construction began. The first was in 2016, when a truck backed over Marvin Franklin, leaving his family, including three children, devastated.OSHA fined SGL more than $12,000 for a serious violation in that incident. While a settlement to the Franklin family’s lawsuit is pending, WESH 2 Investigates uncovered documents that showed SGL made changes to the way it routes traffic in construction zones to prevent future incidents.Later in 2016, Curtis Popkey was killed when he was struck by a piece of construction equipment in Altamonte Springs. OSHA levied no fines in that case.In March of last year, Michael Tolman died after being struck by a collection of ribar. SGL subcontractor Shelby Erectors was fined more than $12,000. Safety advocates say OSHA fines need to be higher to promote safety.In a 2015 New York-based report, a study of construction deaths concluded construction worker fatalities result in puny penalties for unsafe contractors. Nationally, OSHA inspects fewer than 4% of construction sites.
